Terms of Service

1. Agreement & Platform Usage

By registering, accessing, or taking an assessment on KodeQualify ("Service"), employers and candidates agree to abide by these Terms. KodeQualify provides developer assessment software, isolated browser execution sandboxes, and AI-assisted candidate evaluation metrics.

2. Code Integrity & Fair Assessment Guidelines

To maintain a fair, unbiased hiring ecosystem for all software engineers:

For Candidates

All code submitted must represent your original work or allowed open-source references. Submitting unauthorized external assistance, leaked solution repos, or bypassing environment sandboxes will result in immediate assessment invalidation.

For Employers

Assessments must strictly test job-relevant technical competencies. Employers agree not to distribute candidate submission source code publicly or use candidate work for commercial production without explicit consent.

3. Intellectual Property Rights

KodeQualify retains full ownership of the assessment platform, question bank algorithms, IDE scoring models, and synthetic evaluation frameworks. Candidates retain ownership of original code submitted, granting the employer a limited license to evaluate candidate qualification.

4. Service Level Commitment & Liability Limits

Uptime Guarantee: KodeQualify guarantees a 99.9% monthly uptime SLA for enterprise plans. Scheduled maintenance windows are announced at least 72 hours in advance.

Limitation of Liability: To the maximum extent permitted by law, KodeQualify shall not be liable for indirect, incidental, or consequential damages resulting from lost hiring decisions or temporary network delays.
